2. Acceptance of Terms
By engaging our services or signing an engagement letter, you agree to be bound by these Terms and Conditions. You must be at least 18 years of age and have the legal capacity to enter into a binding agreement. These terms apply to all engagements unless expressly varied in writing by a principal of the firm.
3. Description of Services
Thornbridge provides family law advisory and representation services in Malaysia, including advisory on marital property arrangements, representation in contested family proceedings, and variation of existing family arrangements. The scope of services in any particular matter is set out in the engagement letter.
Services are available to clients in Malaysia. Work requiring representation outside Malaysia will be discussed separately at the time of instruction. Availability is subject to the firm's capacity at the time of the request.
4. Client Responsibilities
To enable us to provide services effectively, you agree to:
- — Provide accurate and complete information when requested
- — Respond to requests for documentation or instructions within a reasonable time
- — Notify us promptly of any change in circumstances that may be material to the matter
- — Not request or instruct us to do anything unlawful or in breach of our professional obligations
- — Pay fees in accordance with the engagement letter and any invoices rendered
5. Intellectual Property
All documents, correspondence, and written advice produced by Thornbridge remain our intellectual property until fees in respect of those documents have been paid in full. Upon payment, you receive a non-exclusive licence to use the documents for the purposes for which they were prepared. Our website content is owned by Thornbridge and may not be reproduced without prior written permission.
6. Fees and Payment
Fees are set out in the engagement letter. We endeavour to provide fixed fees for advisory matters where the scope is sufficiently defined. For contested proceedings, fees are quoted by reference to the expected scope and updated if that scope changes materially.
- — Invoices are payable within fourteen days of the invoice date unless otherwise agreed
- — Disbursements (court fees, filing charges, etc.) are invoiced separately and are payable promptly
- — We may pause work on a matter if invoices remain outstanding beyond thirty days without explanation
- — All fees are denominated in Malaysian Ringgit (RM)
7. Disclaimers
Legal advice is provided based on the information available to us and the law as it stands at the time advice is given. We do not warrant that any particular outcome will result from the services we provide. Family proceedings involve discretionary decisions by courts, and no adviser can determine the outcome of such decisions in advance.
Our website is provided for general information and does not constitute legal advice. Nothing on the website creates a solicitor-client relationship.
8. Limitation of Liability
To the extent permitted by law, our liability to you in connection with any matter is limited to the fees paid by you in respect of that specific matter. We are not liable for indirect, consequential, or special damages. Nothing in these terms limits liability for fraud, wilful default, or death or personal injury arising from negligence.
9. Termination
Either party may terminate an engagement by giving reasonable written notice. We may decline to continue an engagement if we are required by professional obligations to do so, or if fees remain outstanding beyond thirty days without an agreed arrangement.
On termination, fees for work completed to the date of termination are payable. We will provide a summary of the matter status and, unless professional obligations prevent us from doing so, assist in arranging an orderly handover to alternative counsel.
10. Dispute Resolution
In the event of a dispute about our services or fees, we ask that you contact us in writing in the first instance. We will endeavour to resolve complaints informally and promptly.
These Terms and Conditions are governed by the laws of Malaysia. Any dispute that cannot be resolved informally will be subject to the exclusive jurisdiction of the courts of Penang, Malaysia.
11. Changes to These Terms
We may update these Terms and Conditions from time to time. The current version is available on this page. Engagements commenced before any update are governed by the version in force at the time the engagement letter was agreed, unless the client consents to the updated terms.
